Recently, the 10th executive meeting of the Ministry of agriculture in 2012 deliberated and adopted the measures of the people's Republic of China for the registration of fishing vessels, which will be issued and implemented in the form of ministerial orders in the near future.
China is a big fishing country as well as a big fishing boat country. According to statistics, by the end of 2011, the total number of fishing vessels in China was 1069600, including 696200 motorized fishing vessels and 373400 non motorized fishing vessels. Since the implementation of the current measures for the registration of fishing vessels on june1,1996, it has played an important role in regulating the registration of fishing vessels and strengthening the management of fishing vessels. However, with the continuous development of fishery economy, the management and registration of fishery vessels are also facing many new situations and problems. It is urgent to carefully summarize practical experience, fully consider the current management needs, and revise and improve the current measures for the registration of fishery vessels in accordance with relevant laws and regulations.
To revise and improve the current measures for the registration of fishing vessels, first, to meet the actual needs of the management of fishing vessels. The current regulations lack the provisions on the registered residence of ship owners, which leads to the phenomenon that fishing vessels are attached to other places is very common, disrupting the normal management order of fishing vessels and adversely affecting the safety production of fisheries. At the same time, the registration link in the current regulations is not connected with the approval of vessel net tool indicators, the inspection of fishing vessels and the issuance of fishing licenses, which leads to the disconnection of management and brings difficulties to the standardization, informatization and modern management of fishing vessels. Second, link up with relevant laws and regulations. Fishery ship registration is a basic system of fishery ship management, which mainly includes ownership registration and nationality registration. According to the property law, regulations on ship registration and other laws and regulations, the two are legal acts of different nature. However, the current Measures stipulate that the two kinds of registration should be applied for at the same time and mutually conditioned, so that the parties are at a loss. Third, enhance operability. The regulations of the current measures on some links of fishing vessel registration are not operable, and need to be supplemented and improved. For example, as an important part of ship registration, there is no specific provision for the approval of ship name; There is also a lack of specific content in the public publicity of registration items, basis, procedures and time limit.
The revision of the measures for the registration of fishing vessels focuses on the following aspects: first, according to the notice of the Ministry of agriculture on strengthening the management of fishing vessels and controlling the intensity of marine fishing during the 12th Five Year Plan period approved by the State Council, it is proposed to change the registration place of fishing vessels to register at the registered residence of the owner of the vessel or at the registration place of the enterprise, At the same time, it is clear that the provincial registration authority should determine the registration authority and port of registry according to the actual situation of fishery vessel management in its administrative region, and publish the registration place and port of registry of fishing vessels to the public. Second, according to the actual needs, the verification of the name of fishing vessels will be taken as an important management link of fishing vessels. It is planned to further clarify the status, approval authorities, application procedures, material requirements and validity period of the verification of the name of fishing vessels that can be applied for, so as to promote its reasonable and effective connection with the approval of the indicators of fishing nets and tools, the inspection, registration of fishing vessels, fishing permits and other links. Third, according to the provisions of the property law and the regulations on ship registration, it is proposed to change the "simultaneous handling" of the ownership registration and nationality registration of fishing vessels to "separate handling". If the owner of the ship requests to handle it at the same time, it can be handled at the same time, and the same materials are not required to be submitted. Fourth, according to the actual management, simplify and optimize the fishing vessel registration certificate. It is proposed to combine the current fishing vessel registration certificate and nationality certificate into the fishing vessel nationality certificate, and distinguish different navigation operation areas in the text format. Fifthly, according to the work needs, it is planned to increase the bareboat charter of fishing vessels, issue temporary fishing vessel nationality certificates, register the invalid circumstances of certificates, establish and improve the fishing vessel database and registration files, and improve the information management level of fishing vessels.
The revision and improvement of the measures for the registration of fishing vessels has further enriched the content and enhanced the operability.
